Our house is heated by a gas furnace. Last fall, after the furnace had been off for a few months, we were cleaning and re-lighting it as the weather became colder. He took the front off and did a little cleaning inside. After a few minutes he walked back to the thermostat and turned it back up. Swoosh... It came on just fine once again. He put the front panel back on and said “I can’t fix what’s not broken” and handed me a bill for $108.00 and asked me to sign the invoice saying he performed his work. All I could really do was sign and pay him. He then left.
In an hour or so I had to re-light the pilot light since it wasn’t working again. I contemplated calling the furnace people but I really didn’t want to deal with that negative guy again and wondered what my alternatives were. Since I felt a bit ripped off I decided to call my LegalShield provider law firm to see where I stood legally since I did sign the invoice. They told me about a law called “Implied warranty of merchantability”. This makes that company responsible with or without my signed invoice to make sure the job was properly done. They also offered to look over the invoice and said if they attempted to charge anymore to fix the furnace properly to call them and they would take care of it.
I called the furnace company back and explained what happened and that our furnace still wasn’t working properly. I also explained what my attorney told me and that I wanted someone, other than that earlier guy to finish what I had paid for. They immediately sent another guy who was very friendly. He told me never let anyone service that type of furnace without taking apart and cleaning the pilot light assembly. He did that which took quite awhile and the furnace worked fine from then on. He said he was told about my call and there would be no additional charge for his work.
